AT RED DEER
1.0
Purpose of
Agreement
This Agreement will stipulate
procedures for payment under the fixed mileage Method of pay outlined in Article
1.18 of the Brotherhood of Locomotive Engineers Collective Agreement and
Article 1. 24 of the United Transportation Union Collective Agreement for the
Leduc Subdivision between Red Deer and South Edmonton (which includes Lambton
Park and Clover Bar), the Wetaskiwin and Leduc Subdivisions between Red Deer,
Wetaskiwin and Hardisty as well as Hardisty, Wetaskiwin and South Edmonton
(which includes Lambton Park and Clover Bar).
2.0
Coverage
Locomotive Engineers, Conductors,
and Trainpersons with home terminal Red Deer will be governed by the terms of
this Agreement.
3.0 Specific Language
3.1 A Crew who commences a straightaway tour of duty in Red Deer,
Hardisty or South Edmonton (which includes Lambton Park and Clover Bar) and is
deadheaded out of working service
will be paid the same as if the crew had completed the entire trip working on
the train to the objective terminal or by Dual Method of Pay, whichever is
greater. Trains between Hardisty and South Edmonton will be paid actual miles
run account fixed rate not applicable.
3.2 A Crew who commences a straightaway tour of duty in Red Deer,
Hardisty, South Edmonton (which includes Lambton Park and Clover Bar) and is
deadheaded into working service will
be paid the same as if the crew had completed the entire trip working on the
train to the objective terminal or by Dual Method of Pay, whichever is greater.
Trains between Hardisty and South Edmonton will be paid actual miles run
account fixed rate not applicable.
3.3 The $80.00 premium payment provided in Article 27.12
Brotherhood of Locomotive Engineers Collective Agreement and Article 29.13
United Transportation Union Collective Agreement for all crews operating on the
Subdivisions noted in 1.0 will apply to the entire tour of duty regardless if
in the objective terminal or in deadhead service prior to 10 hours when on duty
over 10 hours.
3.4
A Crew that gives notice as provided in Article 27.04 BLE
Collective Agreement or 29.05 UTU Collective Agreement and is relieved will
revert to the dual method of calculating pay and Clauses 3.1, 3.2, and 3.3 of
this Agreement will not apply.
3.5
Article 27.12 of the Brotherhood of Locomotive Engineers
Collective Agreement and Article 29.13 of the United Transportation Union
Collective Agreement will apply in that the crews will be in and off duty
within 12 hours.
4.0
Additional
Language
4.1
All Conductor Only payments/premiums will be paid
in accordance with the current collective agreement. This agreement has no
impact on the application of these claims.
4.2
Trains that are delayed or behind another train
similarly delayed outside the objective terminal up to and including Kavanaugh,
Stroick or Wolf Creek, will be paid on the per minute basis for all time over
two (2) hours. This claim will be in addition to all other earnings for that
tour of duty. This claim should be submitted using the CMA claim code NN. The time of this claim will cease
when the train reaches the OMTS of their objective terminal (South Edmonton or
Red Deer). Miles claims in accordance with this provision are to be considered
as non-chargeable.
4.3
If the crew is required to perform switching at the
locations specified in item 4.2, then they will be required to deduct all time
involved in the Conductor Only switching from the NN claim stipulated in this agreement. There will be no duplicate
payment allowed.
5.0 Cancellation Clause
This Agreement is without precedent or prejudice to either party and can be
amended, revised or cancelled upon seven days’ written notice by either party.
